Terms of Use

Last updated: July 10, 2026

1. Parties and Nature of the Service

These terms are between you and Talivio Technology OÜ, which operates the FinAI platform (Estonian Commercial Register no. 16991406; address: Ahtri tn 12, Kesklinna linnaosa, Tallinn, Harju maakond, 15551, Estonia; the "Company"). By creating an account or using the platform, you accept these terms.

FinAI is an investment research and decision-support tool that offers educational content, backtesting (testing a strategy on historical data), paper trading, portfolio tracking, and AI-assisted chat and report features.

2. Not Investment Advice

The Company is not an investment firm authorised by the SPK (the Turkish Capital Markets Board) and does not provide investment advisory or portfolio management services, which require an SPK licence in Türkiye. The signals, scenarios, backtest results, reports and AI answers on the platform are general in nature; they are not personalised, they have not been assessed against your financial situation or your risk and return preferences, and none of them is a recommendation, advice or a "buy/sell" instruction. The word "signal" as used on the platform describes a technical market indicator or model output; it must not be read as a trading recommendation or as personalised investment advice. Past performance and backtest results are not an indicator or guarantee of future returns. All investment decisions and their consequences are yours alone; where appropriate, you should seek personalised advice from an SPK-licensed investment firm.

3. AI Output and Market Data

Chat answers, reports, signals and some blog content on the platform are produced partly or wholly by artificial intelligence. AI output can contain errors, gaps or outdated information; it is your responsibility to verify it before relying on it for any decision.

Market data (fund prices, stock, crypto and currency rates, etc.) comes from third-party sources such as TEFAS, CoinGecko, the European Central Bank (Frankfurter), Stooq and Yahoo Finance; it may be delayed and may contain errors or outages. The Company does not guarantee the accuracy, completeness or timeliness of this data; before you trade, you should confirm prices with your broker or an official source.

4. Account Creation and Security

When you create an account, you agree to provide accurate and current information. You are responsible for keeping your account credentials confidential and for everything done through your account. If you notice suspicious access, you must contact us.

5. Acceptable Use

  • Loading the platform with automated tools (bots, scrapers) beyond reasonable usage limits,
  • Attempting to get around rate limits or abuse protections,
  • Using the AI features to generate unlawful or harmful content, or content that infringes the rights of others,
  • Reverse engineering the platform or copying its source without permission

is prohibited.

6. Fees and Subscription

Free, Plus and Pro subscription plans are available. Fees for paid plans are charged in advance at the start of each period, in the amount and frequency shown at checkout, through our payment service provider Stripe; your card details are not stored in the Company's systems. You can cancel your subscription at any time from your account settings (the Stripe billing portal); cancellation takes effect at the end of the current billing period, and fees already paid for that period are not refunded, subject to mandatory legal provisions. Your rights under consumer law are reserved.

Right of withdrawal (consumers). As a rule, in distance contracts concluded as a consumer you have a right to withdraw within 14 days without giving a reason. However, if performance of our digital service begins with your express consent before the withdrawal period has expired, your right of withdrawal for that service ends under Article 15(1) of the Turkish Distance Contracts Regulation. When you start a subscription, you will be asked to confirm this consent, and the loss of the right of withdrawal, separately and expressly; if you do not give this consent, the service starts only after the statutory withdrawal period has expired. Where the statutory right of withdrawal applies, your payment is refunded.

7. Limitation of Liability

The platform is provided "as is" and "as available"; we do not guarantee that it will work without interruption, without errors or securely. Past performance, backtest results and scenario projections do not guarantee future returns; you alone are responsible for the consequences of your investment decisions. To the maximum extent permitted by applicable law, the Company is not liable for indirect or consequential losses such as investment losses or loss of profit, nor for losses arising from third-party data provider outages, market data delays or errors in AI output. In all cases, the Company's total liability arising from these terms is limited to the total fees you paid to the Company in the twelve (12) months before the event giving rise to the claim; where you use the service free of charge, this cap is EUR 100 (or its equivalent). This limitation does not apply to liability for intent (bad faith) or gross negligence, for death or bodily injury, or arising from mandatory consumer protection law, or to any other liability that cannot be limited by law.

8. Intellectual Property

The software, design, trademarks and content on the platform belong to the Company or its licensors. Portfolio and transaction data entered by a user belongs to that user.

9. Changes

We may update these terms from time to time; for material changes we will notify you on the platform or by email. If you keep using the platform after an update, you accept the updated terms.

10. Consumers

The service is offered primarily for personal information and decision-support purposes. If you use the service as a consumer, the mandatory consumer protection provisions of the place where you live (your habitual residence) apply; for consumers resident in Türkiye, the mandatory provisions of Turkish consumer law are reserved, above all Consumer Protection Law No. 6502 and the related regulations. The "Governing Law and Jurisdiction" and "Limitation of Liability" provisions below, and the disclaimers of warranty, apply only to the extent that these mandatory provisions allow. Consumers resident in Türkiye keep their right to apply to the consumer arbitration committees and consumer courts in their place of residence.

11. Governing Law and Jurisdiction

These terms are governed by the law of the Republic of Estonia; the United Nations Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-laws rules do not apply. Subject to Section 10 above, the Harju County Court in Tallinn (Harju Maakohus) has exclusive jurisdiction over disputes arising from these terms.

Nothing in this section deprives you of the protection afforded by mandatory provisions of law, which cannot be varied by contract, of your habitual residence or place of residence. Accordingly, if you are a consumer resident in Türkiye, the mandatory protection that Turkish consumer law gives you, and your right to apply to the competent consumer arbitration committee or court, are reserved in all cases.
